This Privacy Policy applies to your personal data as users of the website (hereinafter “Users”) operating at www.primepv.pl (hereinafter “Website”), as well as other persons indicated in this Privacy Policy.

Our Privacy Policy is subject to Polish law and complies with the GDPR.

Who is the administrator of your personal data?

Prime PV sp. z o.o. together with Prime PV Construction sp. z o.o. with its registered office in (80-868) Gdańsk, ul. Marynarki Polskiej 163, NIP: 5833423023, entered into the register kept by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register under KRS number: 0001015786, are joint controllers of your personal data.

What is involved in data sharing?

Prime PV sp. z o.o. and Prime PV Construction sp. z o.o. jointly determine the purposes and means of processing your personal data as part of business cooperation.

The joint controllers agreed that Prime PV sp. z o.o. will be responsible for the processing and protection of personal data processed by joint controllers as part of the implementation of common goals.

Prime PV sp. z o.o. will act as a leader in relation to the processing of your personal data, which means that Prime PV sp. z o.o. fulfills all obligations towards you resulting from the provisions on the protection of personal data. In order to exercise the rights arising from the GDPR, which are described below, we recommend submitting an appropriate application to Prime PV sp. z o.o. If you contact Prime PV Construction sp. z o.o. this request will be forwarded to Prime PV sp. z o.o.

In order to correctly identify you, please provide your name, surname, telephone number, and if you are authorized to represent us, also the name of the entity on behalf of which you have acted or are acting. In case of doubts related to identification, we may ask you to provide additional data or information.

Source and scope of processed data

We collect your personal data that has been provided to us via the Website.

As part of the personal data that has been provided to us, we can process, first of all: name, surname, delivery address, e-mail address, telephone number or name of the company or entity you represent.

Please do not send your personal data in a wider scope than is necessary to conduct a given case or answer a given inquiry. We reserve the right to delete such data immediately, even without contacting you first.

The data controller made it possible to provide contact and land lease data via the contact form. By submitting the contact form, you consent to the processing of data contained in the form. Your data provided in this way will be used to develop a personalized land lease offer.

Bases and purposes of personal data processing

Your personal data will be processed:

– on the basis of your consent (based on Article 6(1)(a) of the GDPR),
Consent is necessary e.g. to enable us to send you an offer.
– to take action at your request related to the possibility of concluding a contract with you in the future (Article 6(1)(b) of the GDPR),
In the event of an inquiry regarding a specific case, we process your personal data in order to provide an answer and conclude a contract in the future.
– in order to pursue our legitimate interests in order to contact you (the basis of Article 6(1)(f) of the GDPR),
We may contact you to provide information on how to proceed in a given case or to consider a complaint.
– in order to achieve our internal administrative purposes, including internal statistics, which are the implementation of our legitimate interest (basis of art. 6 sec. 1 lit. f GDPR);

We keep internal statistics to optimize the customer service process.
– for archival purposes (evidence) which is the implementation of our legitimate interest in securing information in the event of a legal need to prove facts (the basis of Article 6(1)(f) of the GDPR);
We store and secure personal data for possible future tax or civil proceedings.
– in order to possibly determine, investigate or defend against claims being the implementation of our legitimate interest (the basis of Article 6(1)(f) of the GDPR).
We store and secure personal data at least until the expiry of the limitation periods resulting from the provisions of civil law.

Please note that providing personal data is voluntary, but necessary to use the services of our Website.

In the case of persons under the age of 16, consent should be given or confirmed by a parent or guardian.

Processing automation

Your data will not be subject to automated decision making, including profiling.

Categories of data recipients

Your personal data may be transferred to entities authorized under the law and, to a limited extent, to entities with whom we cooperate on a regular basis, such as ICT system providers, website hosting companies, law firms or courier companies that deliver parcels to you.

We will make every effort to ensure that the scope of the information provided is always necessary and adequate to achieve the assumed goals.

Data transfer

We will not transfer your personal data outside the territory of the Republic of Poland.

Data storage period

We store your data for the period necessary to perform the contract and for the time specified in applicable law, but not longer than it is necessary for the purposes of our or your legitimate interests, i.e., inter alia, for the purpose of pursuing claims for the conducted activity. Data related to the issued invoice will be processed by us until the expiry of the tax liability and until the limitation period for possible claims or the end of the warranty period. If you have consented to the processing of your personal data for specific purposes, e.g. indicated marketing activities, your data will be stored until the consent is withdrawn.

Your rights

The provisions of the GDPR allow you to effectively manage your personal data, therefore, you can:

Exercise your right to object, i.e. receive information about the consents granted to us, as well as withdraw some of them.

Exercise your right to correct information (the right to access data and the right to rectify data), i.e. change your addresses or your personal data in an easy and transparent way.

Exercise your right to be forgotten, i.e. simply delete your data.

Exercise your right to be informed by being able to read the basic information about the processing of personal data by us.

To exercise your right to be notified, if there is a data breach in our system, you should be notified within 72 hours.

Exercise your right to restrict processing if you want us to stop processing the personal data associated with your account.

The recommended and fastest way to exercise your rights is to use e-mail to the address indicated by the joint controllers. Nevertheless, we will make every effort to fulfill your requests received in any other form, including in paper form.

If you submit a request in a different form, we reserve the right to verify your identity. Failure to effectively verify your identity for reasons for which you are responsible means that we will not implement the submitted request, of which you will be informed immediately.

Submission of the application in a form other than e-mail may extend the response time to 30 days. In objectively complex cases, i.e. requiring a lot of work on our part, the above deadline may be extended to two months, of which you will be immediately informed.

Right to complain

In justified cases, you can submit a complaint to the supervisory authority – the President of the Office for Personal Data Protection.

Other provisions

We collect and store your personal data with due diligence. In the case of data processed in electronic form, they will be stored on password-protected servers and in IT systems leased by us from hosting companies and based on separate agreements (so-called data processing agreements). In the case of data processed in paper form will be stored in locked cabinets, in rooms secured with an additional key lock and an alarm system.

Cookies and system logs

Please be advised that as soon as you connect to the Website, information about the number (including IP) and type of your end device from which you connect to the Website appears in the Website’s system logs. Please be advised that we will process, in accordance with the provisions of applicable law, also data regarding the number (including IP) and type of your end device, as well as the time of your connection to the Website and other operational data regarding your activity.
